TERMS OF SALE

1. Scope

These Terms of Sale apply to all purchases made by consumers on the ZERIWW online store. By placing an order, you acknowledge that you have read and accepted these Terms of Sale before completing your purchase.

In the event of any conflict between these Terms of Sale and our Terms of Service regarding a purchase, these Terms of Sale shall prevail. Nothing in our policies limits the rights granted to consumers by mandatory applicable law.

2. Products

The essential characteristics of each product are presented on its product page. Product photos are as accurate as possible but are not contractually binding; slight differences in color or appearance may occur depending on your screen settings.

Products are offered while stocks last. If a product becomes unavailable after your order has been placed, we will inform you as soon as possible and you will be offered a replacement product or a full refund of the amount paid for that product.

3. Prices

Prices are displayed in the currency shown on the website and include all applicable taxes for your delivery country, unless otherwise stated. Shipping costs are not included in the product price; they are calculated and clearly displayed at checkout before you confirm your order.

ZERIWW reserves the right to change its prices at any time. However, products are invoiced at the price in effect at the time your order is placed.

4. Ordering

To place an order, you add products to your cart, provide your delivery and billing information, select a shipping method and a payment method, review your order summary, and then confirm your order with payment.

Your order is confirmed once payment has been accepted. You will receive an order confirmation by email summarizing your purchase. We recommend keeping this email as proof of your order.

ZERIWW reserves the right to refuse or cancel any order in the event of a dispute concerning a previous order, suspected fraud, or an obvious pricing error.

5. Payment

Payment is due in full at the time of ordering. Accepted payment methods are those displayed at checkout. All payments are processed through secure payment providers; ZERIWW never has access to your full card details.

6. Delivery

Products are delivered to the address you provide at checkout, within the delivery times displayed at checkout. Unless a different delivery date has been agreed, products are delivered no later than 30 days after your order is placed.

If delivery does not occur within the agreed time frame, you may ask us to deliver within a reasonable additional period. If we still fail to deliver within that period, you may cancel your order and receive a full refund of all amounts paid, including shipping costs, within 14 days of your cancellation.

Risk of loss or damage to the products passes to you when you, or a person you designate (other than the carrier), take physical possession of them.

7. Right of Withdrawal

In accordance with applicable consumer law, you have 14 days from the date you (or a person you designate) receive the products to withdraw from your purchase, without having to give any reason.

To exercise this right, you must inform us of your decision before the deadline expires, by an unambiguous statement sent through the contact page on our website. You may use the following model form, but this is not mandatory:

"I hereby give notice that I withdraw from my contract for the sale of the following goods: [products], ordered on [date] / received on [date]. Name: [name]. Address: [address]. Date: [date]."

You must return the products no later than 14 days after informing us of your decision. Products must be returned complete, in their original condition and, where possible, in their original packaging. The direct cost of returning the products is borne by you, unless otherwise stated. You are liable for any diminished value of the products resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

We will refund all payments received from you, including standard delivery costs, no later than 14 days after being informed of your decision to withdraw. We may withhold the refund until we have received the returned products or you have provided proof of their return, whichever comes first. The refund will be made using the same payment method you used for the initial purchase, unless you expressly agree otherwise, and at no cost to you.

The right of withdrawal does not apply to certain products, including goods made to the customer's specifications or clearly personalized, goods that are liable to deteriorate or expire rapidly, and sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed after delivery.

8. Legal Guarantees

All products sold by ZERIWW benefit from the legal guarantee of conformity and the legal guarantee against hidden defects, in accordance with applicable law.

Under the legal guarantee of conformity, you have two years from delivery of the product to act. During this period, you may choose between repair or replacement of the product, subject to the cost conditions provided by law. If repair or replacement is impossible or not carried out within a reasonable time, you may obtain a price reduction or cancel the sale and be refunded. Any lack of conformity appearing within two years of delivery is presumed to have existed at the time of delivery, unless proven otherwise.

Under the guarantee against hidden defects, you may act within two years of discovering the defect, and may choose between cancelling the sale or obtaining a price reduction.

These legal guarantees apply independently of any commercial guarantee that may be offered. To make a claim, please contact us through the contact page on our website with your order number, a description of the issue and, where possible, photos.

9. Liability

ZERIWW cannot be held liable for failure to perform its obligations where such failure is due to the customer, to an unforeseeable and insurmountable act of a third party, or to a case of force majeure as defined by applicable law.

10. Personal Data

Personal data collected when you place an order is used to process and deliver your order and to manage our customer relationship. It is processed in accordance with the General Data Protection Regulation (GDPR). For more information and to exercise your rights, please refer to our Privacy Policy.

11. Customer Service and Disputes

If a dispute cannot be resolved with our customer service, you may use a consumer mediation service free of charge. Customers in the European Union may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

12. Governing Law

These Terms of Sale are governed by French law, without prejudice to the mandatory consumer protection provisions of the customer's country of residence. In the absence of an amicable resolution, any dispute shall be brought before the competent courts in accordance with applicable law.
